Expertise

Notices of non-compliance
and litigated files.

Negotiate, remediate, execute. We take the file wherever it's stalled and carry it through to closure, within a reasonable timeframe!

Overview

Taking charge of the file.

A notice of non-compliance, a remediation order, a notice of execution, or an environmental prosecution isn't settled on paper. It's resolved by understanding what actually happened on the ground, then correcting the situation while respecting the disturbed environments and ecosystems. That's the heart of our expertise: taking on a file, whatever stage it's at, and carrying it through to closure.

A waterway channelized without authorization, a wetland filled in, an incomplete characterization that missed a critical element, work in wetlands or waterbodies that doesn't comply with regulations: the situations vary, but the starting point is often the same. The ministry has issued a notice of non-compliance, sometimes a notice of execution, and the business or citizen involved lacks the technical means to respond. Our team then takes charge of the file, from the first contact through to the execution of the work: direct negotiation with MELCCFP and municipalities to rework the timeline while work progresses; the field work required to reposition a waterway or restore a wetland; plans and specifications; and complete execution of the work on site. When a file is contested, we also act as expert witnesses before the courts, to establish the true nature of an environment and defend the file through to remediation.

What it includes

From taking on the file to remediation, on the ground

  • Taking on files already underway, even those under a notice of execution
  • Direct negotiation with MELCCFP to rework the timeline
  • Hydrogeomorphological analysis of a channelized, filled-in, or diverted waterway
  • Redevelopment plans and specifications compliant with the waterway's natural parameters
  • Complete execution of restoration work on the ground
  • Representation as an expert witness before the courts
  • Drafting of expert reports admissible before a regulatory or judicial body
  • Follow-up on the file through to remediation and closure

Our method

Taking on the file, negotiating the time, executing in the right place.

  1. Taking on and reviewing the file

Complete review of the history: notices received, existing reports, correspondence with the ministry. We identify what was missed and what's urgent.

  2. Building the work plan

Development of the negotiation strategy and of a corrective action plan tailored to the situation.

  3. Negotiation with the ministry

Direct contact with MELCCFP to suspend or postpone enforcement measures while the file is being resolved, and to prevent the government from sending its own team to the site.

  4. Fieldwork and remediation

Execution of the corrective work according to the defined parameters, with follow-up through to the closure of the file.
